- Workplace Injuries and Workers Compensation — A worker injured on the job, is eligible for workers’ compensation. This is a form of insurance involving wage replacement and medical benefits. We’ll advise and represent you throughout . . and make sure that you know about things like:
- Mileage payments for medical visits
- Increase in your rate because of a second job held at time of injury
- Third-party claims — if the negligence of a third party (not your employer) contributed to your injury, we can represent you in a claim against the third party, which may compensate you much more fully for your injury (including payment for pain and suffering) than workers’ compensation alone.
- Unemployment Benefits — We’ve advised and successfully represented both workers and employers over many years.
- Pre-Separation — If possible, planning is important for both worker and employer prior to a separation.
- After Separation –A worker may be eligible even if fired for poor performance. However, if the employer can show that the discharge was for misconduct or a violation of a company rule, unemployment compensation will not be payable. And benefits may be payable event after voluntary separations, depending on the circumstances.
- Discrimination: It is illegal to treat a person differently (discriminate) on the job because of race, sex, disability, national origin, and a number of other factors. Claims for employment discrimination must be filed promptly! Call us to discuss.
- Sexual Harassment: Sexual harassment in the workplace is against the law, and so is someone retaliating against a person for making a complaint. Every business must enforce a strict policy pertaining to sexual harassment and make the written policy available to every employee. Harassers can be either male or female, and the victim does not have to be of the opposite sex. A harrasser can be a coworker, manager, supervisor, or even a non-employee working in the same vicinity as the victim.
- Nonpayment of Wages, Wage and Hour Issues, Overtime: Wages must be paid regularly and promptly! Similarly, overtime must be paid if required under state or federal law. Failures can give rise to claims for triple damges.
- Benefits, including Vacation and Family Medical leave — These rights are governed by law, and cannot be taken away arbitrarily.
